1) Purpose and scope

2) Products – Fine art photographic prints
The Website offers fine art photographic prints (the “Products”), possibly available as limited editions, with various finishes (e.g., fine art print, mounting, Chromaluxe, framing/float frame, etc., as described on the relevant Product pages).
Product images, descriptions, sizes and colour renderings are presented with the greatest care. However, the final appearance may vary due to:
- the Customer’s screen calibration,
- the nature of printing substrates and production processes,
- technical constraints of production partners/labs where applicable.
Such reasonable variations cannot be considered a lack of conformity.
3) Availability – Limited editions
Products are offered subject to availability and, where applicable, within the announced edition limit.
If a Product becomes unavailable after an order is placed, the Seller will inform the Customer as soon as possible and will offer:
- a refund, or
- an equivalent solution (with the Customer’s consent), or
- a revised lead time (with the Customer’s consent).
4) Prices – Taxes – Delivery fees
Prices shown on the Website are in euros (€), VAT included, excluding delivery fees unless stated otherwise.
Delivery/packaging fees (and, where applicable, insurance, customs duties outside the EU, and local taxes) are shown before the order is confirmed.
The Seller may change prices at any time. The price charged is the one in force at the time the order is placed.
5) Orders – Online checkout
Orders are placed online via the Website. An order becomes binding when:
- the Customer validates the cart and provides the required information (delivery, billing, options, etc.),
- the Customer accepts these Terms, and
- payment is confirmed.
An order confirmation email may be sent to the Customer. The Customer should keep this confirmation.
6) Made-to-order and custom Products
Some Products may be made-to-order or customised (size, finish, framing, numbering, signature, etc.).
In such cases, the Customer acknowledges that production may start shortly after the order is placed.
--> Important (see Section 10): custom-made or personalised Products may be excluded from the right of withdrawal.
7) Payment
Payment is made online using the methods offered on the Website: credit card, Bancontact, bank transfer, PayPal, Stripe, etc...
The Seller may suspend or refuse an order in case of:
- payment default,
- suspected fraud,
- previous payment incidents.
Title to the Products remains with the Seller until full payment has been received.
8) Delivery – Lead times – Risk transfer
Products are delivered to the address provided by the Customer.
Delivery areas: Belgium / EU / worldwide
Indicative lead times: [to be completed: e.g., 7–15 business days depending on finish] (lead times may vary depending on production, carriers and peak periods).
Risk transfers:
- for a consumer Customer, risk passes upon physical receipt of the Products by the Customer (or a third party designated by the Customer),
- unless mandatory legal provisions provide otherwise.
The Customer must check the parcel upon delivery and report any issue (damaged parcel, damaged Product) as soon as possible and at the latest within 48 hours, including photos, to facilitate any claim with the carrier.
9) Legal warranties – Conformity
The Seller remains bound by the mandatory legal warranties applicable in Belgium, including:
- the legal guarantee of conformity for consumers (where applicable), and
- the warranty against hidden defects under Belgian law.
In case of a clearly non-conforming Product or damage at delivery, the Customer must contact the Seller at p.marnef@isoway.eu, describing the issue and providing evidence (photos, order number).
10) Right of withdrawal (distance selling)
10.1 Principle (consumers)
If the Customer is a consumer (a natural person acting outside their trade/business), the Customer generally has 14 calendar days from receipt of the Product to withdraw from the purchase, without giving any reason.
10.2 Exceptions – Custom-made / personalised Products
Under the rules applicable to distance sales, the right of withdrawal does not apply to Products:
- made to the Customer’s specifications,
- clearly personalised,
- produced on demand (e.g., specific size, finish, made-to-measure framing, dedicated numbering/signature, etc.).
When a Product falls within this category, the Customer is deemed to accept this at the time of ordering.
10.3 Returns (where withdrawal applies)
Where withdrawal applies:
- The Customer must notify the Seller before the deadline by email to p.marnef@isoway.eu
- The Customer must return the Product at their own cost within 14 calendar days after notification.
- Products must be returned in their original condition and with appropriate protective packaging.
Refunds are made after receipt and inspection of the returned Product, using the same payment method unless agreed otherwise.
11) Returns – Refunds – Exchanges
Except in cases of confirmed non-conformity or carrier-related damage (subject to evidence), Products that are custom-made or made-to-order are not exchangeable and are not refundable.
Where an issue is confirmed (conformity/transport), the Seller may propose:
- replacement,
- repair where appropriate,
- refund,
depending on the most suitable solution.
12) Intellectual property
All photographic works (images, series, titles, texts and graphic elements) displayed on the Website are protected by copyright and remain the intellectual property of their author and/or the Seller.
Purchasing a fine art print does not transfer any reproduction, representation, distribution, commercial exploitation or modification rights, unless expressly agreed in writing.
13) Liability
To the extent permitted by law, the Seller shall not be liable for:
- misuse or improper handling of the Products,
- indirect damages (loss of profit, loss of opportunity, reputational harm, etc.),
- reasonable colour/rendering variations resulting from screens and production processes (see Section 2).
14) Force majeure
The Seller shall not be liable for non-performance or delay caused by events beyond its reasonable control (force majeure), including but not limited to carrier strikes, fire, natural disasters, major supply disruptions, or significant technical failures.
15) Personal data
Personal data collected in connection with an order is used for:
- order processing,
- billing,
- delivery,
- after-sales service.
Data is processed in compliance with applicable data protection rules (including the GDPR).

16) Governing law – Jurisdiction
These Terms are governed by Belgian law, to the extent permitted by applicable conflict-of-law rules and mandatory consumer protection provisions.
In the event of a dispute, the courts having jurisdiction over the Seller’s registered office shall have exclusive jurisdiction.
